This Beebox privacy policy (“Privacy Policy” or “Policy”) was last modified on March 23, 2012, and was first published and made effective February 2011. Click here for the previous version.

Beebox LLC is the corporate name for Beebox. In this Policy, we will refer to Beebox as “Beebox”, “our”, “us” or “we.”

Beebox, LLC (“Beebox”, “we”, “us and “our”) offers the Users access to its interactive online websites, applications and services. This Privacy Policy explains what information may be collected when the Users access our website (“Website”) or use any of our mobile or other applications (“Applications”), how we use this information, and under what circumstances we may disclose the information to third parties. Depending on the Users activities when using or accessing our Website or Applications (collectively, “Services”), the Users may from time-to-time be required to agree to additional terms and conditions.

Please note that this Privacy Policy applies regardless of whether the Users use our Services via a computer, mobile device or other platform (collectively, the Users “Equipment”). Also, this Privacy Policy applies only to information we collect through our Services and does not apply to our collection of information from other sources (e.g., in person, over the telephone, etc.).

We take the Users privacy seriously. We are providing this Policy to inform the Users of our policies and procedures regarding the collection, use and disclosure of information on our Service. We also want to inform the Users about the Users choices regarding information. If the Users have any questions or concerns, please let us know (see “How to contact us” section below).

Unless otherwise defined in this Policy, terms used in this Policy have the same meanings as in our Beebox Terms and Conditions of Service, accessible at http://Beebox.com/about/terms and Conditions/. As used in this Policy, the terms “using” and “processing” information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within our organization or among our affiliates within the United States or internationally.

MODIFICATIONS TO THIS PRIVACY POLICY

We generally keep this Privacy Policy posted on our Website. The Users should review this Privacy Policy frequently, as it may change from time to time without notice. Any changes will be effective immediately upon the posting of the revised Privacy Policy. WHEN THE USERS USES OUR SERVICES, THE USERS AGREES TO THIS PRIVACY POLICY. IF THE USERS DO NOT AGREE TO THIS PRIVACY POLICY, OR TO ANY CHANGES WE MAY SUBSEQUENTLY MAKE, IMMEDIATELY STOP USING OUR SERVICES. Please note, however, that if we decide to use the Users personally identifiable information in a manner materially different than what is provided in this Privacy Policy or what we advised at the time it was collected, we will notify the Users of this change by e-mail to the last e-mail address provided to us or through our Applications. The Users will have a choice (by means of an “opt out” opportunity) as to whether or not we use their information in this different manner. In such case, we will use the Users personally identifiable information in accordance with the terms in place when the information was collected.

Note that this Policy may be modified from time to time in our sole discretion, so check back frequently. We will notify the Users of any changes to the Policy by posting a new Policy and updating the “last modified” date at the top of this page.

INFORMATION WE COLLECT

We typically collect two kinds of information about the Users when the Users use our Services: (a) information that the Users provide that personally identifies the Users; and (b) information that does not personally identify the Users that we automatically collect or that the Users provide us.

Personally Identifiable Information: Our definition of personally identifiable information includes any information that may be used to specifically identify or contact the Users, such as the Users name, mail address, phone number, etc. As a general policy, we do not automatically collect the Users personally identifiable information when the Users visit our Website. In certain circumstances, we may request, allow or otherwise provide the Users an opportunity to submit the Users personally identifiable information in connection with a feature, program, promotion or some other aspect of our Services. For instance, the Users may: (a) provide the Users name, mail/shipping address, email address, credit card number and phone number when registering or in connection with a contest entry; (b) provide certain demographic information about the Users (e.g., age, gender, purchase preference, usage frequency, etc.) when using our Applications, or participating in a survey or poll; or (c) post a general comment and/or recommendation on our Website or through our Applications. Certain information may not be personally identifiable when standing alone (e.g., the Users age), but may become so when combined with other information (e.g., the Users age and name). Whether or not the Users provide this information is the Users choice; however, in many instances this type of information is required to participate in the particular activity, realize a benefit we may offer, or gain access to certain content or features available through our Services.

Social Web Information: including but limited to the Users Facebook connect credentials (and information that the Users authorize Facebook share with us though permissions like this http://developers.facebook.com/images/devsite/auth-dialog-example.png) and email account information. If the Users authorize and provide it to us, we may also collect information concerning e-mail contacts and other social web information. To help the Users connect friends and contacts the Users may want to use our service with (as well as to improve or services and fight fraud), we also allow the Users to import data from other social web services, including but not limited to Twitter, and email service providers.

Non-Personally Identifiable Information: Our definition of non-personally identifiable information is any information that does not personally identify the Users. Non-personally identifiable information can include certain personally identifiable information that has been de-identified; that is, information that has been rendered anonymous. We obtain non-personally identifiable information about the Users from information that the Users provide us, either separately or together with the Users personally identifiable information. We also automatically collect certain non-personally identifiable information from the Users when the Users access or use our Services through the Users Equipment. This information can include, among other things, the Users mobile device, wireless carrier, IP addresses, the type of browser the Users are using (e.g., Internet Explorer, Firefox, Safari, Opera, etc.), the third party website from which the Users visit originated, the operating system the Users are using (e.g., Vista, Windows XP, Mac OS, Android, iPhone, etc.), the domain name of the Users Internet service provider (e.g., America Online, NetZero, etc.), the search terms the Users use; and how much the Users use our Services.

HOW WE USE & SHARE THE INFORMATION COLLECTED

Personally Identifiable Information: The personally identifiable information the Users submit to us is generally used to carry out the Users requests, respond to the Users inquiries, better serve the Users, or in other ways naturally associated with the circumstances in which the Users provided the information. We may also use this information to later contact the Users for a variety of reasons, such as customer service, providing the Users promotional information for our products or those of our parent company, subsidiaries or other affiliated companies (“affiliated companies”), or to communicate with the Users about content or other information the Users have posted or shared with us via use of our Services. The Users may opt-out from receiving future promotional information from us or our affiliated companies, or direct that we not share the Users information with any affiliated companies, as set forth below.

In certain instances we may also share the Users personally identifiable information with our third party vendors performing functions on our behalf (or on behalf of our affiliated companies) – e.g., vendors that process credit card orders, administer our promotions, provide us marketing or promotional assistance, analyze our data, assist us with customer service, etc. Our vendors agree to use this information, and we share information with them, only to carry out our requests. In addition, we may share the Users personally identifiable information with participating sponsors to a program or promotion (e.g., a sweepstakes or contest) the Users enter via our Services and certain co-promotional partners and others with whom we have marketing or other relationships. Except as provided in this Privacy Policy, our Terms of Use, or as set forth when the Users submit the information, the Users personally identifiable information will not be shared or sold to any third parties without the Users prior approval.

Social Web information: The Users social web, should the Users designate the Users Beebox account transactions as “public” such that other Beebox users can view the Users payments or when the Users otherwise request Beebox payments be posted to the Users social web, will be shared with the general public and other parties. The Users may access our privacy controls to designate that all of the Users payments are private as well. When the Users broadcast information to third party services, such information is no longer under the control of Beebox and is subject to the terms of use and privacy policies of such third parties. Beebox will not send the Users personal information to third party social networks unless the Users have specifically requested or authorized us to do so.

When submitting a gift, the Users agree to allow Beebox to publish the Users gift amount, and any associated artwork on Beeboxs’ internal news feed as well as the recipient’s Facebook and/or Twitter wall. All end users with access to Beebox can see any and all users’ gifts and gift amounts for any gift recipients through the website site and mobile application.

Non-Personally Identifiable Information: We use non-personally identifiable information in a variety of ways. For example, we may use non-personally identifiable information to evaluate use of our Services (e.g., visits to our Website, use of our Applications, etc.), track the types of products being purchased, gauge coupon redemption rates, understand customer needs and trends, carry out targeted promotional activities, and to improve our services. We may use the Users non-personally identifiable information by itself or aggregate it with information we have obtained from other customers or other sources. We may, among other things, share the Users non-personally identifiable information with our affiliated companies and/or sell it to third parties to achieve these and any other business objectives (e.g., generate revenue, form alliances, etc.). However, it is important to remember that the Users non-personally identifiable information (whether standing alone or combined with other non-personally identifiable information) is anonymous information that does not personally identify the Users.
Beebox may also share this information with any directly participating retailers and strategic partners that provide products or services to our users.

SHARING OF THE USERS INFORMATION

Beebox Users. When the Users register through the Service and submit Personal Information to create a profile or visual collection, other Beebox Users will see the Users name. If the Users choose to provide additional Personal Information in the Users profile, Beebox Users will see such additional Personal Information, including, but not limited to, the Users photo, location, website and biography. Providing additional Personal Information is voluntary and should correlate with the degree of interaction the Users want to have with Beebox Users. We recommend that the Users guard and refrain from disclosing any information the Users consider sensitive and confidential.

Aggregate Information and Non-Identifying Information. We may share aggregated information that does not include Personal Information and we may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling and other purposes. Any aggregated information shared in these contexts will not contain the Users Personal Information.

Service Providers. We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services (e.g., maintenance services, database management, web analytics and improvement of the Service’s features) or to assist us in analyzing how our Service are used. These third parties have access to the Users Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
Social Networking Sites. We may share the information in the Users Beebox account (including the Users Personal Information) with the SNSs that the Users have linked to the Users Beebox account. These third parties have access to the Users Personal Information only for this purpose (unless the SNS has received the Users Personal Information independently of the Service) and not for other purposes.

Facebook Connect and Twitter. We allow Users to link their Facebook and Twitter accounts to our Service. Users can then post recent activity on our Service back to their Facebook and Twitter accounts. The Users will be prompted to decide whether or not the Users activity on the Service will be shared and disclosed on the Users Facebook/Twitter service. The Users can disable the foregoing feature at any time by logging into the Users profile and selecting the option to disable Facebook Connect and/or Twitter. Further, the Users may be able to edit the Users privacy settings for the content that the Users post which appears on Facebook/Twitter by making selections in the Users “Edit Profile” settings via the Service.

Compliance with Laws and Law Enforcement. Beebox cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We can disclose any information about the Users to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process including, but not limited to, subpoenas, to protect the property and rights of Beebox or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.

Business Transfers. Beebox may sell, divest, transfer, assign, share or otherwise engage in a transaction that involves, some or all of our assets, including any or all of the information described in this Policy, in the course of a corporate divestiture, merger, acquisition, joint venture, bankruptcy, dissolution, reorganization, or any other similar transaction or proceeding.

HOW WE COLLECT INFORMATION

We collect information that the Users voluntarily provide to become a registered User of our Service, and when the Users use certain aspects of our Service (e.g., entering an email address on a form to send an email from the Users Beebox account).

We collect information when the Users register to join Beebox by logging into an account that the Users already have with certain third-party social networking sites (“SNS”) (including, but not limited to, Facebook and Twitter) via our Service. For example, our Service allows the Users to create an account and login to the Service using the Users Facebook account credentials through Facebook Connect. If the Users are not currently registered as a User on the Service and the Users click on “Sign in Using Facebook,” the Users will first be asked to enter the Users Facebook credentials and then be given the option to register and join Beebox.

When the Users browse or use our Service, technological tools including “Log Data” and “Cookies” collect certain information, as explained in the following section.

WHAT INFORMATION WE COLLECT AND HOW WE USE IT

Personal Information. When the Users register with us through the Service to become a registered Users of Beebox, we will ask the Users for certain information about the Users that can be used to contact or identify the Users (“Personal Information”). Personal Information may include, but is not limited to, the Users name, gender, profile photo, free-form biography, location/hometown, website and email address. If the Users decide to create a Beebox Account by logging into a SNS via the Service, the Users are using the Personal Information the Users have already provided to the SNS (such as the Users “real” name, email address and other information the Users make publicly available via the SNS) to create the Beebox Account on our Service; the information we collect may depend on the privacy settings the Users have with the SNS, so please consult the SNS’s privacy and data practices. For example, by using Facebook Connect, the Users are allowing Beebox to access the Personal Information in the Users Facebook account pursuant to the Facebook Terms of Use regarding the Users use of the Service via Facebook.

We use the Users Personal Information (in some cases, in conjunction with the Users “Non-Identifying Information,” see below) to provide the Service to the Users. For example:

Account registration. We create the Beebox Account for the Users use of the Service based upon the Personal Information the Users provide.

Communications. We use the Users Personal Information to contact the Users with Beebox newsletters, marketing or promotional materials and other information that may be of interest to the Users. If the Users decide at any time that the Users no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications or update the Users “preferences” information in the Users account settings. (See “The Users choices regarding information,” below.)

Customer service. We use the Users Personal Information to respond to the Users questions and/or inquiries.

Finding friends. The Users also have the option to import the Users personal contacts (including email addresses of friend lists via SNS) to the Service so that the Users can find the Users friends on the Service, and the Users friends can find the Users on the Service.

Emailing via a Beebox Account. As part of the Service, Beebox Users may communicate with other registered and non-registered Users through use of their Beebox accounts. Where Users have selected the option of adding one or more email addresses to an online form, the message they create in the corresponding template will be sent from Beebox to those email addresses on their behalf.

Non-Identifying Information. We also collect other information that the Users provide as part of registration, the operation, and personalization of the Users boards on Beebox that cannot reasonably be used to identify or contact the Users (e.g., without limitation, age and individual preferences) (“Non-Identifying Information”). Certain Non-Identifying Information would be considered a part of the Users Personal Information if it were combined with other identifiers (for example, combining the Users zip code with the Users street address) in a way that enables the Users to be personally identified or contacted. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other Non-Identifying Information (for example, the Users viewing preferences)

We may combine the Users Personal Information with Non-Identifying Information and aggregate it with information collected from other Beebox Users to attempt to provide the Users with a better experience, to improve the quality and value of the Service and to analyze and understand how our Service is used. We may also use the combined information without aggregating it to serve the Users specifically, for instance to deliver a product to the Users according to the Users preferences or restrictions.

Mobile Software. Our Mobile Software allows Users to access and use the Service from their mobile devices. From the Mobile Software, the Users also have the option to identify the location of Users Content that the Users wish to upload to our Service. In addition, in the event that our Mobile Software crashes on the Users mobile device, we will receive information about the Users mobile device model, software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our Mobile Software.

Log Data. When the Users visit the Service, whether as a registered User or a non-registered Users just browsing, our servers automatically record information that the Users browser sends whenever the Users visit a website (“Log Data”). This Log Data may include information such as the browser type or the webpage the Users were visiting before the Users came to our Service, pages of our Service that the Users visit, the time spent on those pages, information the Users search for on our Service, access times and dates, and other statistics. We use this information to monitor and analyze use of the Service and the Service’s technical administration, to increase our Service’s functionality and Users-friendliness, and to better tailor our Service to our visitors’ needs. For example, some of this information is collected so that when the Users visit the Service again, it will recognize the Users and the information could then be used to serve advertisements and other information appropriate to the Users interests. We also use this information to verify that visitors to the Service meet the criteria required to process their requests.

COOKIES AND PREFERENCE BASED ADVERTISING

Cookies and Web Beacons: We use “cookies” and “web beacons” (also called “clear gifs” or “pixel tags”) to obtain certain types of information when the Users access our Website via the Users Equipment. “Cookies” are small files that we transfer to the Users Equipment’s hard drive, memory or web browser to enable our systems to recognize the Users. For instance, cookies allow us to remember Service preferences the Users have previously set. “Web beacons” are tiny graphics with a unique identifier, similar in function to cookies, and may be used to track the online movements of users, when an email has been opened, and to provide other information.

Examples of the information we collect and analyze in this manner include the Internet protocol (IP) address used to connect the Users Equipment to the Internet; the Users browser type and version, operating system, and platform; the Users activities on our Website, including the URL the Users come from and go to next (whether this URL is on our site or not); and cookie number. It is important to note that the cookies and Web beacons that we use do not contain and are not tied to personally identifiable information.

If the Users are concerned about the storage and use of cookies, the Users may be able to delete cookies manually from the Users hard drive or mobile device or take other steps to prevent cookies from loading in the first place. Please note, however, that some portions of our Services will not function properly or be available to the Users if the Users refuse to accept a cookie or choose to disable the acceptance of cookies.

Preference Based Advertising: We may now or in the future work with third parties, including third party advertising networks and website analysis firms, who use cookies and web beacons (also called “clear gifs” and “pixel tags”) to collect non-personally identifiable information when the Users visit our Website and third party sites. This non-personally identifiable information, collected through cookies and web beacons, is often used by these advertising networks to serve the Users with advertisements, while on third party sites, tailored to meet the Users preferences and needs.

If the Users do not wish to be served third party advertising via these third party advertising networks, please click here and follow the simple opt-out process. A couple of important notes about this opt-out tool: (1) it includes all the advertising networks that we may work with, but also many that we do not work with; and (2) it may rely on cookies to ensure that a given advertising network does not collect information about the Users (“Opt-out Cookies”) – for a general explanation of how Opt-out Cookies work, please click here. Therefore, if the Users use or buy new Equipment, change web browser or delete these Opt-out Cookies, the Users will need to perform the opt-out task again.

OTHER USES & INFORMATION

IP Addresses: An IP address is a number that is automatically assigned to the Users Equipment whenever the Users access the Internet. Web servers (computers that “serve up” web pages) automatically identify the Users Equipment by its IP address. When visitors request pages from our Website, our servers typically log their IP addresses. We collect IP addresses for purposes of system administration, to report non-personal aggregate information to others, and to track the use of our Services. IP addresses are considered non-personally identifiable information and may also be shared as provided above. It is not our practice to link IP addresses to anything personally identifiable; that is, the visitor’s session will be logged, but the visitor remains anonymous to us. However, we reserve the right to use IP addresses to identify a visitor at the request of the visitor or when we feel it is necessary to enforce compliance with our Service rules or to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our Services, or other users; or (d) in an emergency to protect the health and safety of our customers or the general public.

Email Communications: If the Users send us an email with questions or comments, we may use the Users personally identifiable information to respond to the Users questions or comments, and we may save the Users questions or comments for future reference. For security reasons, we do not recommend that the Users send non-public personal information, such as passwords, social security numbers, or bank account information, to us by email. However, aside from our reply to such an email, it is not our standard practice to send the Users email unless the Users request a particular service or sign up for a feature that involves email communications, it relates to purchases the Users have made with us (e.g., product updates, customer support, etc.), we are sending the Users information about our other products and services, or the Users consented to being contacted by email for a particular purpose. In certain instances, we may provide the Users with the option to set the Users preferences for receiving email communications from us; that is, agree to some communications but not others. The Users may “opt out” of receiving future commercial email communications from us by clicking the “unsubscribe” link included at the bottom of most emails we send, or as provided below; provided, however, we reserve the right to send the Users transactional emails such as customer service communications.

Transfer of Assets: As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all (or substantially all) of our assets, the personally identifiable information and non-personally identifiable information we have about the Users will be transferred to and used by this acquiring entity, though we will take reasonable steps to ensure that the Users preferences are followed. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

Other: Regardless of any other provision in this Privacy Policy, we reserve the right to disclose any personally identifiable or non-personally identifiable information about the Users if we are required to do so by law, with respect to copyright and other intellectual property infringement claims, or if we believe that such action is necessary to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our Services, or other users; or (d) in an emergency to protect the health and safety of our customers or the general public.

The Users California Privacy Rights: Residents of the State of California, under certain provisions of the California Civil Code, have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain personally identifiable information as defined under California law during the preceding year for third party direct marketing purposes. The Users are limited to one request per calendar year. In the Users request, please attest to the fact that the Users are a California resident and provide a current California address for our response. THE USERS CHOICES REGARDING INFORMATION

The Users have several choices regarding the use of information on our Service:

Email Communications. If the Users decide at any time that the Users no longer wish to receive email communications from us, please follow the unsubscribe instructions provided in any of the communications or update the Users “preferences” information in the Users account settings Cookies.

If the Users decide at any time that the Users no longer wish to accept cookies from our Service for any of the purposes described above, then the Users can instruct the Users browser, by changing its settings, to stop accepting cookies or to prompt the Users before accepting a cookie from the websites the Users visit. Consult the Users browser’s technical information. If the Users do not accept cookies, however, the Users may not be able to use all portions of the Service or all functionality of the Service. If the Users have any questions about how to disable or modify cookies, please let us know at the contact information provided below.

De-Linking SNS. If the Users decide at any time that the Users no longer wish to have the Users SNS account (e.g., Facebook or Twitter) linked to the Users Beebox account, then the Users may de-link the SNS account in the “preferences” section in the Users account settings.

Changing or Deleting The Users Information. All Users may review, update, correct or delete the Personal Information in their Users account (including any imported contacts) by contacting us or by editing their profile via the Service. If the Users completely delete all of the Users Personal Information, then the Beebox Account may become deactivated. We will use commercially reasonable efforts to honor the Users request. We may retain an archived copy of the Users records as required by law or for legitimate business purposes. (For more information on how to control the Users User Content on the Beebox Service, including information regarding the use and storage of the Users User Content, please see the “Sharing The Users Content” section in our Terms and Conditions of Service.)

PUBLIC FORUMS

We may offer chat rooms, blogs, message boards, bulletin boards, or similar public forums where the Users and other users of our Services can communicate. The protections described in this Privacy Policy do not apply when the Users provide information (including personal information) in connection with the Users use of these public forums. We may use personally identifiable and non-personally identifiable information about the Users to identify the Users with a posting in a public forum. Any information the Users share in a public forum is public information and may be seen or collected by anyone, including third parties that do not adhere to our Privacy Policy. We are not responsible for events arising from the distribution of any information the Users choose to publicly post or share through our Services.

CHILDRENS INFORMATION

The features, programs, promotions and other aspects of our Services requiring the submission of personally identifiable information are not intended for children. We do not knowingly collect personally identifiable information from children under the age of 13. If the Users are a parent or guardian of a child under the age of 13 and believe he or she has disclosed personally identifiable information to us please contact us at info@Beebox.me. A parent or guardian of a child under the age of 13 may review and request deletion of such child’s personally identifiable information as well as prohibit the use of that information.

KEEPING THE USERS INFORMATION SECURE

We have implemented security measures we consider reasonable and appropriate to protect against the loss, misuse and alteration of the information under our control. Please be advised, however, that while we strive to protect the Users personally identifiable information and privacy, we cannot guarantee or warrant the security of any information the Users disclose or transmit to us online or through our Services, and are not responsible for the theft, destruction, or inadvertent disclosure of the Users personally identifiable information. In the unfortunate event that the Users “personally identifiable information” (as the term or similar terms are defined by any applicable law requiring notice upon a security breach) is compromised, we may notify the Users by e-mail (at our sole and absolute discretion) to the last e-mail address the Users have provided us in the most expedient time reasonable under the circumstances; provided, however, delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system as well as for the legitimate needs of law enforcement if notification would impede a criminal investigation. From time to time we evaluate new technology for protecting information, and when appropriate, we upgrade our information security systems.

HOW WE STORE AND PROTECT INFORMATION

Information Security. We care about the security of the Users information. We use commercially reasonable safeguards to preserve the integrity and security of information collected and maintained through the Service. However, we cannot ensure or warrant the security of any information the Users provide to us or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed by unauthorized persons.
